1. Agreement to Terms
By accessing or using PixelTrack ("the Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Platform.
These Terms apply to all users of PixelTrack, including individuals, teams, organizations, and client portal users.
2. Description of Service
PixelTrack is a comprehensive project management platform that provides:
- Project and task management with customizable Kanban boards
- Time tracking and reporting capabilities
- Client management and communication tools
- Invoice generation and payment processing
- Team collaboration and workspace management
- Secure credential storage and management
- Advanced reporting and analytics (Professional/Agency plans)
- Client portal access (Agency plans)
- Advanced analytics and priority support (Agency plans)
3. User Accounts and Registration
3.1 Account Creation
To use PixelTrack, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Security
- Use strong passwords and enable two-factor authentication when available
- Do not share your account credentials with others
- Notify us immediately of any unauthorized account access
- You are responsible for all activities that occur under your account
3.3 Accurate Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.
4. Subscription Plans and Billing
4.1 Plan Types
- Starter: Free plan with basic features and usage limits
- Professional: Paid plan with advanced features and team collaboration
- Agency: Premium plan with client portal and advanced analytics features
4.2 Billing and Payments
- Subscription fees are billed in advance on a monthly or annual basis
- All payments are processed securely through Stripe
- Fees are non-refundable except as required by law
- We may change pricing with 30 days' notice to existing subscribers
4.3 Free Trials
Free trials are available for paid plans. Trials automatically convert to paid subscriptions unless canceled before the trial ends. No payment method is required to start a trial.
4.4 Subscription Changes and Cancellation
- You may upgrade, downgrade, or cancel your subscription at any time
- Downgrades take effect at the next billing cycle
- Cancellations are effective immediately, with access maintained until period end
- Data export options are available before account closure
5. Acceptable Use Policy
You agree to use PixelTrack only for lawful purposes and in accordance with these Terms. You may not:
- Use the Platform for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Infringe upon the rights of others, including intellectual property rights
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use the Platform to spam, harass, or abuse others
- Reverse engineer, modify, or create derivative works of our Platform
- Use automated tools to access the Platform without permission
- Store or transmit content that is offensive, defamatory, or inappropriate
6. Intellectual Property Rights
6.1 PixelTrack's Rights
The PixelTrack Platform, including its features, functionality, and content, is owned by PixelTrack and protected by copyright, trademark, and other intellectual property laws.
6.2 Your Content
You retain ownership of any content you upload, create, or store on PixelTrack. By using our Platform, you grant us a license to use, store, and process your content solely to provide our services.
6.3 Feedback
Any feedback, suggestions, or ideas you provide about PixelTrack may be used by us without compensation or attribution.
7. Data Ownership and Portability
- Your Data: You own all data you input into PixelTrack
- Data Export: You can export your data at any time in standard formats
- Data Deletion: Upon account closure, your data will be deleted within 30 days
- Backup Retention: Anonymized backups may be retained for security purposes
8. Platform Availability and Support
8.1 Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. Planned maintenance will be communicated in advance when possible.
8.2 Support
- Starter: Community support and documentation
- Professional: Priority email support
- Agency: Dedicated support with faster response times
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Termination
10.1 Termination by You
You may terminate your account at any time through your account settings or by contacting support.
10.2 Termination by Us
We may terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Fail to pay subscription fees (for paid plans)
- Use the Platform in a way that harms our business or other users
10.3 Effect of Termination
Upon termination, your access to the Platform will cease, and your data will be deleted within 30 days unless you export it beforehand.
11. Disclaimers and Limitations
11.1 Service Disclaimers
The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
11.2 Limitation of Liability
To the maximum extent permitted by law, PixelTrack shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.
11.3 Maximum Liability
Our total liability to you for any claims arising from or relating to these Terms or your use of the Platform shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless PixelTrack from any claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
